Terms of Service
The company is a software/platform provider only. It is not an investment advisor, and it does not custody or hold user assets. Trading carries high risk and users are solely responsible for all of their own profits and losses.
Introduction
This service agreement (the "Agreement") is made between Nanobot Trader Co., Ltd. (the "Company", "we", "our") and the user (the "User", "you") to define the rights, duties, and liabilities of both parties in using the Nanobot Trader platform — including the use of software, the website, the application, automated trading-bot systems, trading tools, trading signals (Signal Bots), API connectivity, and other related services.
Definitions
For clarity in this Agreement, the following terms have these meanings:
- "Service" means the Nanobot Trader platform and all related functions.
- "User account" means the account a user registers to access the system.
- "GAS Credit" means the digital credit a user must top up in advance to pay for services.
- "Subscription Plan" means a monthly service package offered by the Company.
- "API" means the program interface connecting Nanobot with external exchanges.
- "User" means a person or legal entity that registers to use this system.
Purpose of the Agreement
This Agreement is made to define the framework for service delivery, exercise of rights, protection of personal data, and the responsibilities of both parties, so that use of the platform is lawful and secure.
User eligibility
Users must be at least 18 years of age and legally capable of entering into a contract. If the user is a legal entity, the registering person must have authority to act on behalf of that entity.
Account registration
Users must provide accurate, complete, and current information. If the Company finds the information is incorrect or false, the Company has the right to suspend usage without prior notice.
Identity verification and security
The Company may request identity-verification evidence and enable two-factor authentication (2FA) for account security. Users are solely responsible for safeguarding their password and account access, and are responsible for all usage that occurs under their account.
Data retention policy
The Company will retain users' personal data for as long as necessary for the purposes of service delivery and as required by law. The Company will apply strict data-protection measures to prevent unauthorized access.
License grant
The Company grants a non-exclusive, non-transferable, non-sublicensable license allowing the user to access and use the Service solely for the purposes defined in this Agreement.
GAS Credit usage and billing policy
Top-up policy
Users must top up GAS Credit into the system before they can access or use any service on the Nanobot platform. Top-ups can be made through the payment channels the Company specifies: credit/debit card, PromptPay, bank transfer, cryptocurrency (such as USDT, BTC), and TrueMoney Wallet. When payment completes, the system converts the paid amount into GAS Credit at the standard exchange rate: 1 THB = 1 GAS.
Example:
- A user who pays 1,000 THB receives 1,000 GAS.
- If paying with cryptocurrency, the system calculates the value at that currency's exchange rate against THB at the time of the transaction.
Topping up GAS Credit exchanges cash value into credit units for use within the Nanobot system only. Once the top-up transaction is complete, the payment is considered final (Payment is Final) and cannot be reversed or refunded under any circumstances.
Nature of GAS Credit
- GAS Credit is not cash and cannot be converted back to cash.
- GAS Credit is a credit unit representing monetary value within the Nanobot system for purchasing services or paying related fees.
- GAS Credit is not considered an asset held in custody by the Company.
Usage and refund policy
GAS Credit topped up into the system can be used for:
- Purchasing a Subscription Plan
- Paying System Fees
- Purchasing Add-on Services
No cash refund: Once money is topped up and converted to GAS Credit, the Company will not refund it in any case, including where the user has not used all of the GAS Credit.
Example: If a user tops up 100 THB and uses only 10 THB, leaving 90 GAS, the Company will not refund the cash equivalent of 90 THB in any case.
No GAS reversal: Once GAS Credit is used to purchase goods, services, or to activate a bot, the transaction is considered complete and the GAS Credit cannot be cancelled or refunded.
Additional terms
- GAS Credit does not expire, unless the Company officially announces a change of terms.
- The Company reserves the right to adjust the exchange rate, conditions, or method of topping up GAS Credit at any time, without prior notice.
- Topping up GAS Credit confirms that the user has read, understood, and fully accepted this GAS Credit Usage and Billing Policy.
System Fee
To keep the service running continuously and with stability, and to cover the system's technical costs, Nanobot Trader Co., Ltd. automatically deducts a System Fee from the user's GAS Credit on each trading operation (Deal). The System Fee is calculated using the following formula:
System Fee = abs(close.deal - open.deal) × volume × bot.index
Where:
- close.deal — the closing price of the trade or the end of that deal.
- open.deal — the opening price of the deal.
- volume — the amount of the asset traded under that deal.
- bot.index — the bot's index value, an internal variable that sets the fee-deduction rate for each strategy.
This fee is deducted automatically each time a deal is closed, using the user's GAS Credit. If the GAS balance is insufficient, the system may temporarily suspend the bot until more GAS is topped up.
This System Fee is not a trading fee charged by the exchange (Exchange Fee); it is a fee for maintaining the system, network, and Nanobot's resources only. System fees already deducted cannot be reclaimed or refunded under any circumstances.
Purchasing a Subscription Plan
Users can use GAS to purchase service plans — Free, Basic, and Premium — each with different usage rights:
- Free Plan: free for life, includes a demo account, unlimited trading, 3 DCA bots, 1 API connection.
- Basic Plan (1,090 THB/month): all Free Plan features, plus 5 DCA bots, 3 Signal Bots, 2 API accounts, and strategy backtesting.
- Premium Plan (1,990 THB/month): unlimited usage, free for the first 7 days, unlimited DCA and Signal bots, 3 API accounts, and strategy backtesting.
Auto-renew is available only for credit/debit cards and carries a 3% fee.
No refund policy
The user agrees that once GAS Credit is topped up or a Subscription is purchased, no refund is available in any case, except where explicitly required by law. The Company reserves the right to consider cases individually.
Auto-renewal and card-fee policy
Auto-renew works only for payments via credit or debit card. Using such cards carries a fee of 3% of the transaction amount, which is the payment gateway provider's fee.
Payment methods and gateways
The Company supports payment through:
- Credit/debit card (via Xendit Payment Gateway)
- PromptPay
- Bank transfer
- Cryptocurrency (USDT, BTC, etc.)
- TrueMoney Wallet
Payment is considered final once the system receives confirmation from the financial provider. The Company is not responsible for errors from external systems.
Customer support policy
The Company provides customer support equally across all packages, through LINE Official, Discord, and email (nanobotsup@gmail.com).
The support team's role is to help with usage only; it does not provide investment advice or trading decisions.
API permission and security best practices
Users connecting an API between Nanobot and an external exchange must set access permissions appropriately and must not enable withdrawals via the API key. Use the API key only for trading.
- Enable Read/Trade permissions only.
- Disable the Withdrawal permission.
- Always use a password and 2FA.
Cookie policy
The Company uses cookies to improve website performance, analyze usage behavior, and provide an appropriate experience. Users can decline certain types of cookies, but declining may affect parts of the website's functionality.
Privacy policy (PDPA/GDPR)
The Company operates in accordance with the Personal Data Protection Act B.E. 2562 (PDPA) and in line with the General Data Protection Regulation (GDPR). The Company collects personal data to:
- Verify identity and protect account security
- Improve the service to fit users
- Send system notifications and related news
Limitation of liability
The Company is not responsible for direct or indirect damages, loss of data, or lost profits arising from using the service or being unable to access it, for any reason. The Company's maximum aggregate liability shall not exceed the most recent three months of service fees paid by the user.
Risk warning
The digital-asset market is highly volatile. Using automated trading bots can cause financial loss. The Company does not guarantee profit from using bots or from backtesting.
Prohibited uses
Users must not use the Nanobot system for:
- Money laundering or any illegal activity
- Attacking the system, copying, or modifying the software
- Deception, or accessing others' data without authorization
The Company has the right to suspend or terminate accounts immediately if it finds a violation of this clause.
Intellectual property
Ownership of intellectual property
The software, platform, algorithms, trade names, trademarks, logos, source code, documents, manuals, and all content in the Nanobot system are the sole intellectual property of Nanobot Trader Co., Ltd. Reproduction, copying, modification, or public distribution without authorization is prohibited.
License restrictions
The Company grants users the right to access and use the service for normal purposes only; this right cannot be transferred, assigned, or sublicensed to others.
User content
Users remain the owners of the content they create, but grant the Company permission to use, store, and display that content for service delivery only.
Trademarks
Do not use the Company's name or logo for advertising or endorsement without written consent.
Marketing Shield (Marketing Liability Disclaimer)
Scope of marketing materials
Any information, images, video, or content the Company publishes is for public relations and general information only. It does not constitute investment advice or a guarantee of results.
Backtest results
Simulation or backtest results show only assumptions from historical data and cannot be used as evidence to confirm future trading results.
Promotional language
Phrases such as "unlimited" or "earn profit automatically" are merely marketing descriptions under actual usage conditions. The Company does not guarantee such results.
Marketing liability limitation
The Company is not responsible for misunderstandings arising from interpreting marketing materials, or for losses arising from relying on advertising information without verification.
Chargeback prohibition
Definition
A chargeback means disputing or requesting cancellation of a payment with the bank or credit-card provider after the transaction.
User agreement
Once a user tops up GAS or pays for a service, the transaction is final and cannot be cancelled or refunded.
Legal measures in case of violation
If a user performs a chargeback without reasonable cause, the Company has the right to suspend the account, revoke usage rights, and claim actual damages from the user, including bank fees and legal costs.
Legal exception
This prohibition does not waive the user's rights in cases where fraud by a third party can be proven.
Suspension and termination
The Company has the right to suspend or terminate the service without prior notice if it finds a violation of the Agreement or for security reasons.
Force Majeure
The Company is not liable where it cannot provide the service due to force majeure, such as natural disasters, war, system failures, or events beyond the Company's control.
Amendments
The Company reserves the right to amend or update this Agreement at any time, with notice to users via the website or email. Continued use of the service after such notice constitutes acceptance of the amended Agreement.
Assignment of rights
Users may not assign their rights or duties under this Agreement to others, except with the Company's written consent.
Interpretation and severability
If any provision of this Agreement is declared void or unenforceable, the remaining provisions remain in full effect.
Dispute resolution and governing law
All disputes are governed by the laws of the Kingdom of Thailand and fall under the jurisdiction of the Bangkok courts.
Acknowledgment and signature
I acknowledge and fully accept all the terms of this Agreement. Subscribing to and using the service constitutes acceptance of these terms.
